Welcome to Chat Highlight. By installing our browser extension, accessing our website, or using our services, you agree to be bound by these Terms of Service ("Terms").

1. Description of Service

Chat Highlight provides a digital highlighting tool that allows users to mark text on websites, create notes, and structure AI chat conversations ("Service"). The Service operates in a "Local-First" manner, storing data primarily on your device with optional cloud synchronization.

2. User Accounts & Security

You are not required to create an account to use the local features of the extension. However, to use Cloud Sync and the Dashboard, you must register.

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.

3. User Data Ownership

You own your data. Chat Highlight claims no ownership rights over the text you highlight, the notes you write, or the tags you create. We explicitly confirm that your data will NOT be used to train our or third-party AI models.

By using the Cloud Sync feature, you grant us a limited, worldwide, royalty-free license to host, store, and encrypt your data solely for the purpose of providing the Service to you (e.g., displaying your highlights on your other devices).

4. Prohibited Uses

You agree not to misuse the Service. Specifically, you must not:

• Use the Service to violate any laws or infringe upon the intellectual property rights of others.
• Attempt to reverse engineer, decompile, or extract source code from the extension.
• Use automated scripts to "scrape" or excessively query our cloud infrastructure, which may degrade performance for other users.
• Use the Service to store or distribute malicious code, viruses, or harmful content.

5. Payments and Refunds

Chat Highlight offers both free and paid ("VIP") plans. Paid plans are billed in advance on a recurring basis.

• Refunds: We offer a 7-day money-back guarantee for new subscriptions. Please refer to our Refund Policy for details.
• Cancellation: You may cancel your subscription at any time via the Dashboard.

6. Technical Limitations (The "Broken Link" Clause)

Please be aware that the web is dynamic. Websites change, update, or disappear frequently.

• Anchoring: While we use robust algorithms to attach your highlights to specific text, if a website owner significantly changes the page content or HTML structure, your highlights may become "orphaned" or fail to display on the original page.
• 404 Errors: If a webpage is deleted by its owner, Chat Highlight cannot restore the original page. However, your highlighted text and notes will remain safe in your Chat Highlight Dashboard/Sidebar.

7. Termination

We reserve the right to suspend or terminate your access to the Cloud Sync service if you violate these Terms, particularly regarding the abuse of our service infrastructure or storage limits.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." CHAT HIGHLIGHT DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHAT HIGHLIGHT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10. Governing Law

These Terms shall be governed by the laws of the State of California, United States, without respect to its conflict of laws principles.
